Woman: Can we be held accountable if this merger fails?
Man : I believe so.

What is the difference between 'can' and 'could' in the sentences below:
Can we be held accountable if this merger fails?
Could we be held accountable if this merger fails?

Thanks a lot.

in both case we are talking about possibilities.

- I think with can, the speaker expresses an opinion that is available ( be held countable.

with could, we have personal involvement. the possibility is strengthened by the personal doubts of the speaker.
